These Terms of Service (“Terms”) govern your access to and use of the Low & High Presents website, services, communications, and events (collectively, the “Services”). The Services are operated by Low & High Presents (“Low & High,” “we,” “our,” or “us”).

By accessing our website, purchasing or receiving tickets, registering for communications, attending a Low & High event, or otherwise engaging with our Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Our Services

Low & High produces and promotes live events and community programming. We may also provide artist management services and support music releases through label-related and promotional activities.

We may update, modify, pause, or discontinue any aspect of the Services at any time.

2. Eligibility

You must be at least 13 years old to use our website. Some events may have age restrictions (e.g., 18+ or 21+) and you are responsible for complying with all posted age requirements. We may request valid government-issued identification for entry.

3. Ticketing, Entry & Event Policies

- Tickets & Entry

Event entry is subject to:

• Venue policies and capacity limits

• Security screening and safety checks

• Compliance with these Terms and any posted event rules

We reserve the right to refuse entry or remove individuals to maintain safety, compliance, and event operations.

- Lineup, Schedule & Production Changes

Lineups, set times, venues, and event details are subject to change at any time. Changes do not automatically entitle patrons to a refund unless required by law or otherwise stated.

- Weather & Outdoor Events

Outdoor events may be impacted by weather. We may delay, modify, relocate, or cancel events for safety or operational reasons.

4. Refunds & Sales Finality

Unless otherwise stated for a specific event, all sales are final. Refunds, credits, exchanges, or partial refunds may be offered only at our discretion or as required by law.

If an event is postponed or rescheduled, your ticket may remain valid for the new date (if applicable), subject to ticketing platform terms.

Removal for misconduct or violation of these Terms may result in removal without refund.

5. Code of Conduct & Community Standards

Low & High is committed to creating a safe, inclusive, and respectful environment. By attending our events or using our Services, you agree to follow our community standards.

We have zero tolerance for behavior that threatens our community, including but not limited to:

• Racism, bigotry, homophobia, transphobia, sexism, or discrimination of any kind

• Harassment, intimidation, stalking, or unwanted physical contact

• Violence, threats, fighting, or reckless behavior that endangers others

• Destruction of property, theft, or interfering with event operations

• Any action that compromises the safety, enjoyment, or accessibility of an event

Violations may result in removal, refusal of entry, and/or a ban from future events, without refund. We may also involve venue staff, security, or law enforcement as necessary.

If you witness or experience unsafe behavior, notify event staff/security immediately or contact us privately.

6. Assumption of Risk

You understand and voluntarily assume all risks related to attending live events, including (but not limited to):

• Loud music, lighting effects, strobe lights, and crowd conditions

• Physical activity such as dancing or movement in congested spaces

• Weather-related conditions at outdoor events

• Interaction with other patrons

• Consumption of alcohol or other legal substances where permitted

You are responsible for your personal property and well-being at all times.

7. Medical & Accessibility

If you have a medical condition affected by loud sound, lighting, crowds, or strobe effects, you are responsible for taking appropriate precautions. If you require accommodations, please contact us in advance when possible so we can attempt to assist.

8. Photography, Video & Media Release

Low & High events may include photography, video recording, or other media capture for promotional, documentation, or archival purposes. By attending a Low & High event, you acknowledge and consent to being photographed, recorded, or otherwise captured, and to our use of that content in any media (including social media, advertisements, and promotional materials), unless otherwise stated for a specific event.

Not all events are recorded. When applicable, signage or event information may indicate active media capture.

If you have concerns about a specific image or clip, you may contact us at info@lowhighpresents.com. While we cannot guarantee removal in all cases, we will review reasonable requests in good faith.

9. Prohibited Conduct (Website + Communications)

You agree not to:

• Attempt to gain unauthorized access to our site, systems, or data

• Misuse forms, sign-ups, or promotions (including submitting false information)

• Disrupt, overload, scrape, or interfere with the site or Services

• Use our content or branding in a misleading way

• Post or distribute unlawful, abusive, or infringing content through any channels we control

We may restrict access or take action if misuse occurs.

10. Intellectual Property

All content on our website and materials produced by Low & High—including logos, branding, graphics, text, photos, videos, and design elements—are owned by Low & High or used with permission and are protected by intellectual property laws.

You may not reproduce, distribute, or commercially exploit our content without written permission.

Our Services may include or rely on third-party platforms (e.g., ticketing providers, Wix, Meta, Google, Snapchat, social media platforms). We are not responsible for third-party services, content, or policies. Your use of those services may be governed by their terms.

If you opt in to receive communications from us, you consent to receive emails and/or text messages about events, releases, and related updates. You can opt out at any time:

13. Disclaimer of Warranties

To the fullest extent permitted by law, our Services are provided “as is” and “as available.” We do not guarantee that the website will be uninterrupted, error-free, or free from harmful components.

To the fullest extent permitted by law, Low & High shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill arising out of or related to your use of the Services or attendance at events.

Our total liability for any claim shall not exceed the amount paid by you (if any) for the specific event or Service giving rise to the claim.

Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Low & High, its team members, contractors, partners, and affiliates from claims, damages, liabilities, and expenses (including reasonable attorney’s fees) arising from your violation of these Terms, misuse of the Services, or violation of any rights of another person.

16. Termination of Access

We may suspend or terminate access to our website, communications, or events (including banning from future events) if you violate these Terms or pose a risk to others.

17. Governing Law & Venue

These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles. You agree that any dispute arising from these Terms or the Services will be brought in courts located in Minnesota, unless otherwise required by law.

18. Changes to These Terms

We may update these Terms from time to time. The most current version will be posted on our website with the updated Effective Date. Continued use of the Services after changes constitutes acceptance of the updated Terms.
